International Convention for the Protection of All Persons from Enforced Disappearance


Preamble

The States Parties to this Convention,

Considering the obligation of States under the Charter of the United Nations to promote universal respect for, and observance of, human rights and fundamental freedoms,

Having regard to the Universal Declaration of Human Rights,

Recalling the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights and the other relevant international instruments in the fields of human rights, humanitarian law and international criminal law,

Also recalling the Declaration on the Protection of All Persons from Enforced Disappearance adopted by the General Assembly of the United Nations in its resolution 47/133 of 18 December 1992 ,

Aware of the extreme seriousness of enforced disappearance, which constitutes a crime and, in certain circumstances defined in international law, a crime against humanity,

Determined to prevent enforced disappearances and to combat impunity for the crime of enforced disappearance,

Considering the right of any person not to be subjected to enforced disappearance, the right of victims to justice and to reparation,

Affirming the right of any victim to know the truth about the circumstances of an enforced disappearance and the fate of the disappeared person, and the right to freedom to seek, receive and impart information to this end,

Have agreed on the following articles:
Part I
Article 1
1. No one shall be subjected to enforced disappearance.

2. No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification for enforced disappearance.

Article 2
For the purposes of this Convention, "enforced disappearance" is considered to be the arrest, detention, abduction or any other form of deprivation of liberty by agents of the State or by persons or groups of persons acting with the authorization, support or acquiescence of the State, followed by a refusal to acknowledge the deprivation of liberty or by concealment of the fate or whereabouts of the disappeared person, which place such a person outside the protection of the law.

Article 3
Each State Party shall take appropriate measures to investigate acts defined in article 2 committed by persons or groups of persons acting without the authorization, support or acquiescence of the State and to bring those responsible to justice.

Article 4
Each State Party shall take the necessary measures to ensure that enforced disappearance constitutes an offence under its criminal law.

Article 5
The widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law.

Gaza's Hopes Dashed by Morsi and Egyptian Muslim Brotherhood


Ever since the toppling of the Mubarak regime in Egypt, Palestinians in Gaza have hoped that they would see an end to the punishing restrictions on their movement through the Rafah crossing with Egypt, their only gateway to the outside world.

I know first-hand about the hardships these restrictions cause, not only because as a reporter I have covered them for years, but because my family has borne them personally as we have had to go back and forth from our home in Gaza to Egypt for my wife’s medical treatment.

But though there was a loosening of the restrictions since the fall of Egypt’s Mubarak regime, 1.6 million residents in Gaza now face the return of the tight closure imposed on their movement since 2007, as Israel, the occupying power, works with Egypt to impose a tight siege on the area.


Punishing Palestinians for electing Hamas
Israel claimed that the siege was necessary because Hamas, in power in Gaza, represented a threat; meanwhile Egypt bowed to international pressure by shutting down Gaza’s main gateway to the outside world. The goal was in fact the same — to tighten the siege on Gaza to make Hamas’ rule unviable, even though it had won an election in 2006.

Egypt then contended that the Rafah crossing terminal should operate according to the terms of the 2005 “Agreement on Movement and Access” brokered by the United States. This agreement required the presence of European Union “observers” who acted as Israel’s eyes, ears and hands, and the forces of the Palestinian Authority in Ramallah.

However, Hamas’ election victory has changed the rules of the political game, and hundreds of thousands of Palestinians who need to be able to move in and out of Gaza have been the victims.

Instead of welcoming one of the rare democratic exercises in in the Arab world, years before the Arab uprisings that have, so far, led to the fall of long-time rulers in Tunisia, Libya, Yemen and Egypt itself, the so-called international community imposed a boycott on the Palestinians to punish them for the result.

A year and a half after Hamas won legislative elections in both Gaza and the West Bank — declared free and fair by international monitors — Hamas and the western-backed Fatah faction of Palestinian president Mahmoud Abbas, architect of the Oslo Agreement between Israel and the Palestine Liberation Organization, engaged in a brief civil war.

Abbas’ forces aimed to prevent Hamas from gaining hegemony despite their election victory, while Hamas wanted to consolidate its control and prevent what it saw as a coup against its legitimate authority.

In June 2007, the conflict reached a climax, and Hamas ousted the forces loyal to Abbas and established sole control in the interior of Gaza. This only led Israel and its international allies to tighten the siege and closure.

In 2008, Israel declared Gaza — of which it is still legally the occupying power — a “hostile entity” that is dedicated to the destruction of the state of Israel.

Pakistan’s former ambassador to the United States says the two countries must “divorce” as allies rather than prolong a dysfunctional marriage.

“If in 65 years, you haven’t been able to find sufficient common ground to live together, and you had three separations and four reaffirmations of marriage, then maybe the better way is to find friendship outside of the marital bond,” Husain Haqqani said, addressing the Center for the National Interest, a Washington think tank, on Wednesday.

“I’m not for [the US] declaring Pakistan an enemy,” Haqqani said, adding that his reason for proposing a “parting of ways” is due to the idea that “the important things can actually be addressed.”

He pointed to a survey by the Pew Research Center released in June, which indicated that nearly three-in-four Pakistanis considered the United States an enemy, although the US provides Pakistan with billions of dollars in aid.

“If this was an election campaign… you would advise the senator with these kinds of favorability ratings to pull out of the race, instead of spending more money.”

He also said there is friction between Pakistan’s civilian government and military about having good relations with the United States.

Haqqani noted that Pakistan’s military needed to be under greater civilian control, adding that the country’s national interests are defined “by generals, not by civilian leaders.”

He referred to the US assassination drone strikes, anticipating that the United States would push ahead with the campaign even in a post-alliance future.

“I have no realistic expectation of the United States ending the drone campaign and (no realistic expectation of) Pakistan accepting it,” he said.

Pakistani officials and opposition parties have shown their outrage at the drone strikes that have claimed the lives of many people in Pakistan’s tribal areas bordering Afghanistan.

Despite the Pakistani government’s repeated calls on Washington to end the drone attacks, the US government continues its strikes on the tribal regions of the country.

Washington claims its drone strikes target militants, although casualty figures clearly indicate that Pakistani civilians are the main victims of the attacks.

The killing of Pakistani civilians, including women and children, by the US drone strikes have strained relations between the two allies, prompting Pakistani officials to send warnings to the US administration over the assaults.

Pakistanis have held many demonstrations to condemn the United States’ violations of their country’s sovereignty.

UK and German spies feed intelligence to Syrian rebels - reports

British and German spy intelligence on Syrian government troop movement has been shared with rebels (pic) to aid attacks on pro-Assad forces, UK and German newspapers revealed on Sunday.
An unnamed Syrian opposition official admitted that British intelligence is covertly aiding antigovernment forces in Syria, UK weekly newspaper the Sunday Times reported.
British authorities "know about and approve 100%" of intelligence from their Cyprus military bases being passed through Turkey to the troops of the rebel Free Syrian Army (FSA), the official said.   
The UK owns two military bases on the island of Cyprus, one at Dhekelia and another at Akrotiri. The bases monitor regional airwaves and report to the GCHQ (Government Communications Headquarters), Britain’s national electronic surveillance center in Cheltenham, the report said.  
"British intelligence is observing things closely from Cyprus. It's very useful because they find out a great deal," the official said. "The British are giving the information to the Turks and the Americans and we are getting it from the Turks."
According to the source, the most valuable intelligence has been about the movements of troops loyal to President Bashar al-Assad towards the city of Aleppo, which has recently become the ground for fierce clashes between the government and the rebels. 
"The British monitor communications about movements of the government army and we got information about reinforcements being on their way to Aleppo," the official told the newspaper. "We hit at the government troops in Idlib and Saraqib [southwest of Aleppo], with success."
The official claimed that early in August, FSA fighters were given advance warning of two large columns of government troops advancing on Aleppo. One was from Latakia on the Mediterranean coast, and the other from the capital Damascus.
"We ambushed troops and a column of more than 40 tanks in a valley near Saraqib," the official said. "We cut them off and destroyed many of them with repeat attacks with rocket-propelled grenades."
German newspaper Bild also revealed on Sunday that Germany is much more active in Syria than was previously believed. German spies, stationed on ships off the Syrian coast, are transmitting intelligence to the FSA to aid in their campaign against the regime of President Bashar al-Assad, Bild reported.
Agents from Germany's Federal Intelligence Service (BND) are equipped with high-tech spy technology, allowing them to observe troop movements as far inland as 600 kilometers (400 miles). The spies pass their findings onto US and British officers, who then pass the intelligence along to the FSA, Bild said.
The newspaper also claims that BND agents are currently operating at a NATO base in Adana, Turkey, where they eavesdrop on phone calls and radio traffic within Syria.
"No Western intelligence service has such good sources inside Syria" as Germany's BND, Bild quoted an unnamed US intelligence official as saying.

Bernard-Henri Levy Urges Intervention in Syria: His Role in Libya as Example

After all, I live in France, where the greater percent of the French people I meet will immediately go into passionate denunciations of this 63 year old man's narcissism, his self-aggrandizing missions to Bosnia and Sudan to save the world for democracy, and -- for some reason, a pet peeve -- his trademark white shirt buttoned six buttons lower than the average man's (to the "navel", they say, but I myself saw no bellybutton).
But I also felt wary for a more grounded reason: I had just seen Bernard Henri-Levi's new documentary -- about himself, and Libya, and himself -- at its premiere at Cannes. The film details BHL's (as he is called, familiarly, in France) pivotal role in lobbying Western forces to intervene in Libya to protect civilians and bring Gaddafi down. In a nutshell: stirred by moral imperative, BHL snuck into Libya through Egypt in the height of the rebellion, met with the NTC (the National Transitional Council) and then, with one phone call to his buddy Sarkozy, he arranged for key NTC leaders to be flown to the Elysee palace in Paris, where, on March 10, 2011, France promptly recognized the NTC as the legitimate governing body of Libya.

This recognition spurred, the documentary suggests, the resolution a week later, on March 17, by the Security Council to declare a no-fly zone for Libya, and on March 19, NATO began bombing, with French jets the first to enter the fray. Gaddafi fell in August 2011.

The documentary basically follows the passionate self-declared diplomat through his eight month sojourn in the revolution. It begins with men hanging in Libya, killed by Gaddafi, and then follows the rebels on their mission to overthrow the dictator, with BHL in almost every shot.
Throughout, the documentary makes BHL appear to be a major military consultant for the NTC: it is his idea, for example, to open a second front at Jebel Nafusa, which appears to be the strategy that determined the outcome.

The United Nations is phasing out its monitoring mission inside Syria amidst unrelenting violence between government and rebel forces. Saying both sides have "chosen the path of war," a top U.N. peacekeeping official said the last of the remaining monitors inside Syria will pull out by a week from today. The United Nations, meanwhile, has confirmed veteran Algerian diplomat Lakhdar Brahimi will take over as international mediator, replacing Kofi Annan, who resigned two weeks ago. On Thursday, U.N. humanitarian chief Valerie Amos said up to 2.5 million people affected by the Syrian conflict are in need of aid.
Valerie Amos: "Over a million people have been uprooted and face destitution. Perhaps a million more have urgent humanitarian needs due to the widening impact of the crisis on the economy and on people’s livelihoods. Back in March, we estimated that a million people were in need of help. Now as many as 2.5 million are in need of assistance, and we are working to update our plans and our funding requirements."

Outgoing Israeli Home Front Defense Minister Matan Vilnai has claimed that the Tel Aviv regime is prepared for a ‘30-day war’ with Iran.

The claim, first published by Israeli daily Yedioth Aharonot on Sunday, was made after Vilnai was appointed as the regime’s ambassador to China. 

Vilnai also said that ‘during the conflict with Iran, the Tel Aviv regime would suffer only 500 fatalities.’ 

The former Israeli minister also claimed that there are no worries and that the “home front” has never been so well-prepared. 

Iranian authorities have dismissed the repeated Israeli threats of military action against the Islamic Republic, warning that in case Israel makes the mistake of launching such an attack, it will spell the end of the Israeli regime. 

A number of senior Iranian military commanders have also emphasized that in case of any attack on Iran, the conflict is certain to expand well beyond the region.

Mahmoud Abbas supports closing of Rafah crossing by Egypt‎

Morsi on Sunday also appointed a senior judge, Mahmoud Mekki, as vice president. Mekki is a pro-reform judge who publicly spoke against election fraud during Hosni Mubarak's 29-year rule before he was ousted in last year's uprising.

Tantawi was the head of Supreme Council of the Armed Forces (SCAF) which took over after Mubarak was forced from power in February 2011 and Annan was No. 2 on the ruling council. The two men appointed to replace them were also members of the SCAF — something that could indicate either the military's agreement to the shuffle or splits at the highest level of the armed forces.

"The question is now will these decisions end that conflict and the duality of powers or will there be resistance?" said analyst Gamal Abdel-Gawad. "These are huge changes."

Turkey has sent the Syrian rebels fighting in Aleppo their first shipment of shoulder-carried, anti-air FIM-92 Stingers, DEBKAfile’s military sources report. More are on the way to insurgent groups battling government forces around Damascus and other parts of Syria.

In Istanbul, US Secretary of State Hillary Clinton held talks Saturday, Aug. 11, with Turkish Prime Minister Tayyip Erdogan and Syrian opposition figures, after which she announced US and Turkish intelligence services and military would set up a joint working team to plan for “many contingencies including the very horrible scenario of the use of chemical weapons.”

DEBKAfile’s US, Turkish and Israeli intelligence sources are taking into account that Bashar Assad will view the supply of Stingers to the rebels as a game changer that threatens to tip the balance of the war against him and respond with chemical warfare against the rebels, Turkey, Israel and Jordan.

Libya's transitional council hands over power

The National Transitional Council, which has ruled Libya since last year's ouster of Muammar al-Qadhafi, was dissolved in a late-night ceremony in Tripoli on Wednesday.

Council chairman Mustafa Abdel Jalil declared that the assembly is now the sole legitimate representative of the Libyan people.

The assembly was elected in July in the country's first national poll held 60 years. Libya was without a constitution or legislature under the autocratic rule of Qadhafi, who took power in a bloodless coup in 1969.

The assembly will be tasked with advancing the country's democratization process towards the launch of a full government in one year's time. It will be naming a prime minister and drafting a new constitution.

However many things are still unclear. Political parties are scrambling to form alliances with independent candidates in a fight for leadership in the assembly. Also, it has yet to be decided how to choose members of the panel drafting a constitution.

Another challenge is the country's volatile security, especially in Benghazi and other eastern areas. Aug. 9, 2012

Israel willingly acceded to Cairo’s request for permission to deploy fighter planes and armored troop carriers in Sinai, which was ruled a demilitarized buffer zone under their 1979 peace treaty. It shared an interest in President Mohamed Morsi’s counter-terror offensive against lawless Islamist bands.

But when sensational reports started coming in from Cairo about non-existent Egyptian victories in which an improbable “60 gunmen killed,” they realized the “offensive” was largely bogus.

As Egyptian troops press to regain control of Sinai, gunmen attack police station in peninsula

CAIRO — Gunmen sprayed a police station in Egypt’s Sinai with bullets Thursday, setting off a brief firefight with policemen before speeding away in their truck, the latest in a series of attacks against security forces in the increasingly volatile peninsula, security officials said.

Meanwhile, the military sent additional armored and other army vehicles to boost its strength in a hunt for militants in the wake of a deadly weekend attack that killed 16 Egyptian soldiers.

The security officials also said army engineers were making preparations to destroy or shut an elaborate underground tunnel network linking Sinai and Gaza that is used to smuggle weapons, people and basic goods to circumvent border restrictions imposed against the Hamas-controlled territory by Israel and Egypt. The officials all spoke on condition of anonymity because they were not authorized to discuss ongoing operations.

The lawlessness in northern Sinai, which borders both Gaza and Israel, reached a new level with Sunday’s attack on an Egyptian military border post. The attackers killed the 16 soldiers as they were breaking their daily fast for the holy month of Ramadan with a sunset meal. They then commandeered an armored vehicle, which they later used to storm across the border into Israel where they were hit by an Israeli airstrike that killed at least six militants.

The attack has rattled the Egyptian government, prompting the country’s new Islamist president to sack the intelligence chief for failing to act on an Israeli warning of an imminent attack just days before.

Somalia set to birth new government

Chinese authorities in the northwestern province of Xinjiang have banned Muslim officials and students from fasting during the month of Ramadan, prompting an exiled rights group to warn of new violence.

Guidance posted on numerous government websites called on Communist Party leaders to restrict Muslim religious activities during the holy month, including fasting and visiting mosques.

Xinjiang is home to about nine million Uighurs, largely a Muslim ethnic minority, many of whom accuse China's leaders of religious and political persecution.

The region has been rocked by repeated outbreaks of ethnic violence, but China denies claims of repression and relies on tens of thousands of Uighur officials to help it govern the province.

A statement from Zonglang township in Xinjiang's Kashgar district said that "the county committee has issued comprehensive policies on maintaining social stability during the Ramadan period.

"It is forbidden for Communist Party cadres, civil officials (including those who have retired) and students to participate in Ramadan religious activities."

The statement, posted on the Xinjiang government website, urged party leaders to bring "gifts" of food to local village leaders to ensure that they were eating during Ramadan.

Similar orders on curbing Ramadan activities were posted on other local government websites, with the educational bureau of Wensu county urging schools to ensure that students do not enter mosques during Ramadan.

'Administrative methods'

During Ramadan, Muslims fast from dawn to dusk and strive to be more closer to God, pious and charitable.

An exiled rights group, the World Uyghur Congress, warned the policy would force "the Uighur people to resist [Chinese rule] even further."

"By banning fasting during Ramadan, China is using administrative methods to force the Uighur people to eat in an effort to break the fasting," said group spokesman Dilshat Rexit in a statement.

Xinjiang saw its worst ethnic violence in recent times in July, 2009, when Uighurs attacked members of the nation's dominant Han ethnic group in the city of Urumqi, sparking clashes in which 200 people from both sides died, according to the government.
